MXL Hosting - Terms of Service

Introduction
This document outlines the terms and conditions governing your use of MXL Hosting services. By accessing or using our platform, you agree to comply with these Terms of Service ("ToS"), our Privacy Policy, and all applicable laws.
1. Definitions
- MXL Hosting: Refers to Mighty Xtreme Labs and its hosting services.
- You: Any individual or entity using our services.
- Service: Includes all hosting, infrastructure, tools, and support provided by MXL Hosting.
2. Service Agreement
By accessing or using any services provided by Mighty Xtreme Labs ("MXL Hosting", "we", "us", or "our"), you ("Customer", "User", or "you") agree to be bound by these Terms of Service, our Privacy Policy, and all applicable laws and regulations. These terms constitute a legally binding agreement between you and MXL Hosting.
3. Account Registration
You must be at least 13 years old to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. We reserve the right to suspend accounts suspected of unauthorized activity.
Multiple Accounts: Users may not maintain more than one account without prior written permission from MXL Hosting. Creating additional accounts to circumvent limitations or restrictions is strictly prohibited.

Add-ons are stackable and can be applied to any plan.
Example: Run a PostgreSQL database via the Pro Plan Server add-on while staying on the Free tier.
5. Acceptable Use Policy
You agree not to use MXL Hosting services to:
- Host, distribute, or link to illegal content including but not limited to pirated software, malware, or materials violating copyright laws
- Engage in DDoS attacks, port scanning, or any form of network abuse
- Operate phishing schemes, fraudulent activities, or pyramid schemes
- Mine cryptocurrency without explicit written authorization
- Violate the Discord Terms of Service or API guidelines (see https://discord.com/terms for details)
MXL Hosting reserves the right to suspend or terminate any account violating these terms without prior notice. Repeated violations may result in permanent blacklisting from our services.
6. Service Level Agreement
MXL Hosting strives to maintain 99.5% uptime for all paid plans. Free tier services are provided on a best-effort basis with no uptime guarantees. Scheduled maintenance will be announced at least 48 hours in advance via our status page and Discord announcements.
Enterprise customers may qualify for SLA credits based on specific contractual terms.
7. Data Management
Customers are solely responsible for maintaining backups of their data and are encouraged to implement their own backup strategies. MXL Hosting performs routine system backups for disaster recovery purposes, but these should not be relied upon as primary backups.
Upon account termination, all customer data will be permanently deleted from our systems within 30 days.
8. Modifications
MXL Hosting reserves the right to modify these Terms of Service at any time. Material changes will be communicated via email (for paid users), through our Discord community, and on our website at least 30 days prior to implementation. Continued use of our services after changes take effect constitutes acceptance of the modified terms.
9. Disclaimer of Warranties
MXL Hosting provides its services on an "as-is" basis without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free service, and we disclaim all liability for data loss or downtime beyond what is specified in our SLA.
10. Limitation of Liability
MXL Hosting shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use our services. Our total liability to you for any claims is limited to the amount you have paid us in the past 6 months.
11. Intellectual Property
All rights, title, and interest in and to the MXL Hosting platform, including software, trademarks, logos, and documentation, are owned by Mighty Xtreme Labs. You may not modify, reverse engineer, distribute, or sublicense any part of our services without prior written consent.
12. Termination
We reserve the right to terminate or suspend any account at any time without notice if we believe it violates these ToS, applicable laws, or poses a security risk. Accounts inactive for more than 90 days may be automatically deleted.
13. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the United States (California). Any disputes arising from this agreement shall be resolved in the courts located in California, USA.
