Introduction

This document outlines the terms and conditions governing your use of MXL Hosting services. By accessing or using our platform, you agree to comply with these Terms of Service ("ToS"), our Privacy Policy, and all applicable laws.

1. Definitions

  • MXL Hosting:Refers to Mighty Xtreme Labs and its hosting services.
  • You:Any individual or entity using our services.
  • Service:Includes all hosting, infrastructure, tools, and support provided by MXL Hosting.

2. Service Agreement

By accessing or using any services provided by Mighty Xtreme Labs ("MXL Hosting", "we", "us", or "our"), you ("Customer", "User", or "you") agree to be bound by these Terms of Service, our Privacy Policy, and all applicable laws and regulations. These terms constitute a legally binding agreement between you and MXL Hosting.

3. Account Registration

You must be at least 16 years old to create an account. Users under 16 may only create accounts with explicit parental consent in accordance with GDPR requirements. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. We reserve the right to suspend accounts suspected of unauthorized activity.

Multiple Accounts:

Users may not maintain more than one account without prior written permission from MXL Hosting. Creating additional accounts to circumvent limitations or restrictions is strictly prohibited.

Add-ons are stackable and can be applied to any plan.

Example: Run a PostgreSQL database via the Pro Plan Server add-on while staying on the Free tier.

5. Payment Terms & Billing

All fees are charged in advance on a monthly basis and are non-refundable. Payment is due immediately upon invoice generation. Failure to pay within 7 days may result in service suspension.

Important:

  • No refunds for partial months or unused services
  • Price changes require 30 days advance notice
  • Suspended accounts may be terminated after 30 days
  • Data recovery fees apply after account termination

6. Service Availability & SLA

We strive to maintain high service availability. Scheduled maintenance, security updates, and force majeure events are excluded from uptime calculations. No service credits or compensation are provided for service interruptions.

Planned Downtime:

Maintenance windows with 24-hour notice when possible

Emergency Maintenance:

Immediate action for security or stability

7. Data Management & Backups

You are primarily responsible for backing up your data. We provide advance notice for maintenance and create backups for emergency recovery, but do not guarantee data recovery and are not liable for data loss.

Data Retention Policy:

  • Active accounts: Data retained as long as necessary for service provision
  • Suspended accounts: Data retained as long as necessary for account recovery and legal obligations
  • Terminated accounts: Data deleted immediately unless legal obligations require retention
  • Account deletion available through support with data export assistance

8. Acceptable Use Policy

You agree not to use MXL Hosting services for any unlawful, harmful, or prohibited activities. Violations may result in immediate account termination without refund.

Supported Services:

  • Discord bots, scripts, and applications (NodeJS, Python, Java)
  • Web hosting on Nginx servers
  • Databases: MongoDB 4/5/6, PostgreSQL, MariaDB 10.3
  • Game servers (within resource limits)
  • Uptime monitoring tools (Uptime Kuma)
  • All-in-One servers with terminal access (Pro plan only)

Prohibited Content:

  • Illegal content including pirated software, malware, or materials violating copyright laws
  • Adult content, pornography, or sexually explicit material
  • Content promoting violence, terrorism, or hate speech
  • Gambling, lottery, or casino-related content
  • Drug-related content or illegal substances
  • Weapons, explosives, or dangerous materials

Prohibited Activities:

  • DDoS attacks, port scanning, or any form of network abuse
  • Phishing schemes, fraudulent activities, or pyramid schemes
  • Cryptocurrency mining (completely prohibited)
  • Spam, bulk email, or unsolicited communications
  • Hosting proxy services, VPN services, or anonymization tools
  • Resource abuse or excessive network consumption
  • Violating Discord Terms of Service or API guidelines
  • Attempting to circumvent security measures or access restrictions
  • Using VPN/proxy for Discord server verification (usage for hosting access is permitted)

Strictly Prohibited Discord Bots:

  • Self-bots, user account bots, or any scripts violating Discord Terms of Service
  • Network attack tools (DDoS), vulnerability scanners, phishing or fraudulent bots
  • Cryptocurrency miners, spam bots, programs for bypassing restrictions (arbitrage, carding)

Zero Tolerance Policy:

Any violation of child safety, terrorism, or illegal activities will result in immediate account termination and reporting to authorities.

9. Resource Limits & Fair Use

All plans include specific resource limits. Exceeding these limits may result in service throttling or suspension.

Free Plan Limits:

Maximum 150% utilization

2048MB per server

Network Usage:

Unlimited bandwidth up to 1Gbit with fair use policy. Excessive network usage may result in server suspension until issue resolution or additional payment to cover provider costs.

10. Account Termination & Enforcement

Either party may terminate this agreement at any time. We reserve the right to suspend or terminate accounts for violations of these terms.

Enforcement Actions:

Discord Bot Access:

Violations may result in immediate suspension of Discord bot access, preventing server creation, deletion, and management through our Discord interface.

Server Suspension:

Individual servers may be suspended for policy violations while other services remain active, unless additional violations occur.

Termination by User:

  • Cancel anytime through support team
  • No refunds for remaining subscription period
  • Support will assist with data export before deletion

Termination by MXL Hosting:

  • Immediate termination for severe violations (illegal content, attacks)
  • 30-day notice for non-payment
  • 7-day notice for policy violations
  • No refunds upon termination for cause
  • Data deleted immediately upon account termination

11. Limitation of Liability

MXL Hosting's liability is limited to the amount paid for services in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

Disclaimer:

Services are provided "as is" without warranties of any kind. We do not guarantee error-free operation or uninterrupted service.

12. Indemnification

You agree to indemnify and hold harmless MXL Hosting from any claims, damages, or expenses arising from your use of our services, violation of these terms, or infringement of third-party rights.

13. Privacy & Data Protection

We collect and process personal data in accordance with our Privacy Policy and applicable data protection laws including GDPR and CCPA.

  • Withdraw consent

14. Intellectual Property & DMCA

You retain ownership of your content but grant us necessary rights to provide our services. We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA).

DMCA Notice Process:

  • Send DMCA notices to: legal@mx-labs.net
  • Include all required DMCA elements
  • We will investigate and respond within 24-48 hours
  • Repeat infringers will have accounts terminated

Content Responsibility:

You are solely responsible for ensuring your content does not infringe on third-party intellectual property rights.

15. Modifications to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via email or service notifications 30 days in advance.

Continued Use:

Continued use of services after changes constitutes acceptance of the modified terms.

16. Dispute Resolution

Any disputes shall first be resolved through good faith negotiations. If unsuccessful, disputes will be resolved through the competent courts in Frankfurt am Main, Germany, in accordance with German law.

Court Jurisdiction:

All legal proceedings must be brought in Frankfurt am Main, Germany. This does not affect your statutory consumer rights under applicable law.

18. Governing Law & Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of Germany, without regard to conflict of law principles.

Any legal action or proceeding arising under these terms shall be brought exclusively in the courts located in Frankfurt am Main, Germany, and you hereby consent to personal jurisdiction and venue therein.

19. Severability & Entire Agreement

If any provision of these terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and MXL Hosting and supersede all prior agreements and understandings.

20. Acknowledgment

By using MXL Hosting services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.

These terms are legally binding. If you do not agree to these terms, you must not use our services.
